Gather Well LLC (“we” or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.  This Privacy Policy applies to your access and use of our website, located at https://www.joingather.org (the “Site”) and any of its subdomains, and the services we provide to you (the “Services”). This Privacy Policy is incorporated into the Terms of Use found at https://joingather.org/terms-of-use (the “Terms”). 

The Privacy Policy describes the information that we gather from you, how we use and disclose your information, and the steps we take to protect your information.  By using the Site or the App, you consent to the privacy practices described in this Privacy Policy.  

  1. INFORMATION WE COLLECT: 

Through your use of the Site and the Services, we collect information that may identify you personally, whether alone or in combination with other information (“Personal Information”). We collect this information (i) directly from you, (ii) automatically as you navigate through the Site, and (iii) from third parties, such as our business partners or service providers.

The types of Personal Information we collect are:

  • Contact information, such as name, email, and phone number.
  • Login credentials (e.g. phone number).
  • Payment and financial information, such as your credit/debit card number, expiration date and security code, bank account number, and billing address.
  • Demographic information you provide, such as date of birth, age, and gender identity or expression.
  • Videos and photographs.
  • Device information from your computer, web browser or mobile device, including IP address.

We use the information we collect about you to provide the Services, create and manage your account, personalize and improve the Site and Service, and provide technical or administrative support as necessary.

We share information about you in the limited circumstances listed below, and with appropriate safeguards on your privacy.

  • Third-party vendors: We may share information about you with third-party vendors who need the information in order to provide their services to us, or to provide their services to you. This includes vendors that help us provide our Services to you (such as Airtable, Firebase, Stream, Sentry, and any others needed to address operational concerns) and our payment processor Stripe); those that assist us with our marketing efforts; those that help us understand and enhance our Services (like analytics providers); those that make tools to help us run our operations (like programs that help us with task management, scheduling, word processing, email and other communications, and collaboration among our teams); and advisors who perform services or functions on our behalf (such as law firms and auditors). 
  • Legal and regulatory requirements: We may disclose information about you in response to a subpoena, court order, or other governmental request. 
  • Business transfers: In connection with any merger, liquidation, sale of company assets, or acquisition of all or a portion of our business by another company, user information may be transferred or acquired by a third party. 
  • With your consent: We may share and disclose information with your consent. For example, when you authorize us to share your photos on our social media accounts.
  • Aggregated or de-identified information: We may share information that has been aggregated or de-identified so that it can no longer reasonably be used to identify you. For instance, we may use aggregate statistics about the use of our Services.

The Site may contain links or references to websites or services that are operated by third parties, including but not limited to Instagram, TikTok, and YouTube (“Third Party Sites”). Your access and use of Third Party Sites is not governed by this Privacy Policy and will instead be governed by the terms and policies of those Third Party Sites.

  1. YOUR CHOICES: 

You may decline to share certain information with us, in which case we may not be able to provide to you with some of the features and functionality of the Site. 

If you do not wish to receive email offers from us, you may opt out of receiving marketing emails by clicking the “unsubscribe” option in the email or by contacting hello@joingather.org.
 

  1. CHILDREN’S PRIVACY: 

The Site and Services are not intended for or directed to children under the age of thirteen (13), and we do not knowingly collect or store any personal information from children under the age of thirteen (13).  If you are a parent or guardian and discover that your child under 13 years of age has provided us with information, please alert us at hello@joingather.org.

  1. DATA SECURITY: 

We maintain commercially reasonable technical, administrative, and physical safeguards in place to protect your Personal Information from unauthorized access, use, and disclosure. However, there is no such thing as “perfect security” on the internet, and we cannot guarantee the security of your Personal Information. In addition, because internet communication is insecure, it is possible that the information you supply to us via the Site will be intercepted during transmission.  While we strive to protect your information to the best of our ability, we cannot be liable for any breach of our systems or interception of our transmission and hereby disclaim, to the fullest extent provided under law, any liability associated with any claim relating to a breach of security, data, or information. 

  1. SITE VISITORS FROM OUTSIDE OF THE UNITED STATES:

This Site is controlled and operated by Gather Well LLC in the United States.  If you choose to access the Site from outside the United States, you acknowledge that you will be transferring your information, including Personal Information, to the United States for storage and processing.  Where required, we comply with applicable legal frameworks relating to the collection, storage, use, and transfer of personal information.

If you reside in the European Economic Area (“EEA”) or the United Kingdom, we will collect and use your Personal Information only if we have one or more legal bases for doing so under the European Union General Data Protection Regulation (“GDPR”) or the UK General Data Protection Regulation (“UK GDPR”), respectively. This means we collect and use your Personal Information only where our collection and use of your information is (a) with your consent; (b) necessary to perform a contract we are about to enter into or have entered into with you; (c) in our legitimate interests, and your interests and fundamental rights do not override those interests; (d) necessary to protect the vital interests of you or another natural person; or (e) necessary to comply with a legal obligation.

Under certain circumstances, by law you have the right to request access to your personal data, request correction of your data, or request erasure of your data.  If you want to exercise any of the rights described above, or are dissatisfied with the way we have used your information, please contact hello@joingather.org. We will seek to deal with your request without undue delay, and in any event in accordance with the requirements of the GDPR.  Please note we may keep a record of your communications to help us resolve any issues which you raise.  We may not accommodate a request to change or delete information if we believe the change or deletion would violate any law or legal requirement, or negatively affect the information’s accuracy.

If you have any complaints about how we handle your personal data please contact us so we can resolve the issue, where possible.  If you need to make a complaint or believe we have otherwise violated your rights, you have the right to lodge a complaint about the use of any of your information with the Information Commissioner’s Office (the UK data protection regulator) or your country’s Data Protection Authority.

  1. PRIVACY POLICY UPDATES 

This Privacy Policy may be updated periodically and without prior notice to you to reflect changes in our information practices or relevant laws. We will indicate at the top of this Privacy Policy when it was last updated.

  1. DO NOT TRACK SIGNALS AND OTHER COMMUNICATIONS

Certain web browsers allow you to instruct your browser to send Do Not Track (“DNT”) signals to websites you visit, informing those sites that you do not want your online activities to be tracked. At this time, our Site is not designed to respond to DNT signals or similar mechanisms from browsers. For information about Do Not Track, please visit: www.allaboutdnt.org.

From time to time, we may email you with information regarding important developments affecting the Services. We may also email you regarding the Site on occasion.
